1. Acceptance of Terms
By accessing or using our hosting services, you agree to comply with and be bound by these terms and conditions. Your use of the services constitutes your acceptance of these terms. By agreeing to these terms, you also agree to our Fair Use Policy, Service Level Agreement, and Privacy Policy. If you do not agree with any part of these terms, you should not use the services.
2. Service Description
We provide hosting services that allow users to utilize server resources for hosting and managing their services. Our hosting services include access to server resources such as CPU, memory, disk space, bandwidth, and network connectivity to ensure optimal performance for users. While we strive to maintain high performance and uptime, occasional maintenance and unforeseen issues may occur.
3. User Responsibilities
Users are responsible for the content and activities on their hosting services, ensuring compliance with all applicable laws and regulations. You must not use our services for any illegal or malicious activities, including but not limited to cheating, hacking, or infringing upon intellectual property rights. It is also your responsibility to maintain the security of your hosting service and user accounts.
4. Payment and Billing
Users can cancel their subscription at any time by logging into their account and navigating to the `My Services` section. Cancellations must be submitted at least 24 hours before the renewal date to avoid being charged for the upcoming billing cycle. Upon cancellation, access to the hosting service and associated services will terminate at the end of the current billing cycle. No partial refunds are given for unused portions of the subscription period.
5. Cancellation Policy
Users can cancel their subscription at any time by logging into their account and navigating to the `My Services` section. Cancellations must be submitted at least 24 hours before the renewal date to avoid being charged for the upcoming billing cycle. Upon cancellation, access to the hosting service and associated services will terminate immediately. No partial refunds are given for unused portions of the subscription period.
6. Refund Policy
We offer a 7-day refund policy. If you are not satisfied with our hosting services within the first 7 days of purchase, you may request a refund. To be eligible for a refund, you must contact our support team within the 7-day period with relevant details of your request. Refunds requested after the 7-day period will not be processed. Refunds are not provided for unused portions of the subscription period beyond this initial 7 days. Exceptions to this policy may be considered under specific circumstances such as billing errors or service issues. Refund requests are reviewed on a case-by-case basis and may be subject to approval.
7. Termination
We reserve the right to suspend or terminate services for violations of these terms or for any other reason deemed necessary. If your account is terminated due to violations, you may lose access to your hosting service data. Legal action may be taken if your actions result in harm to our infrastructure, network, or reputation.
8. Limitation of Liability
We are not liable for any damages or losses resulting from the use or inability to use our hosting services. This includes direct, indirect, incidental, consequential, or punitive damages arising from the use or misuse of our services. While we aim to provide reliable hosting, you acknowledge that no online service is completely immune to vulnerabilities, and you use our services at your own risk.
9. Changes to Terms
We may update these terms from time to time, and continued use of our services constitutes acceptance of the updated terms. We will notify you of any significant changes to these terms via email or by prominently displaying a notice on our website. It's your responsibility to review these terms periodically to stay informed about any changes that may affect your use of our services.
10. Chargebacks
In the event of a chargeback or payment dispute initiated by you against Trinura, your account may be suspended or terminated at our discretion. Chargebacks constitute a violation of these terms and conditions and may result in the loss of access to your hosting service and data. Any outstanding fees resulting from the chargeback, including chargeback fees, will be your responsibility. We reserve the right to take legal action to recover any outstanding debts.
11. Fair Use Policy
By using our hosting services, you agree to adhere to our Fair Use Policy, which outlines acceptable usage of resources and prohibits activities that may negatively impact the performance or stability of our services.
12. Privacy Policy
Your use of our hosting services is also subject to our Privacy Policy, which governs how we collect, use, and protect your personal information. By using our services, you consent to the terms of our Privacy Policy.
13. Coupon Usage and Pricing Adjustments
Users may utilize coupons or promotional codes when purchasing our hosting services. However, we reserve the right to remove or invalidate coupons if we are no longer able to provide the services at the specified price or if adjustments are necessary for sustainability reasons. Additionally, prices may increase if maintaining the current pricing becomes unsustainable for us. We will make reasonable efforts to notify users of any such changes in advance.
14. Hosting Services
For customers utilizing hosting services from Trinura, including hosting and Virtual Private Server (VPS) hosting, the following terms apply:
- Provisioning: We will provision the server(s) or VPS as per the specifications outlined in the chosen hosting plan.
- Ownership: The server(s) remain the property of Trinura. Customers are granted the right to use the server resources allocated to them based on their chosen plan.
- Usage: Customers are responsible for the content and activities on their server(s). Usage must comply with all applicable laws and regulations. Prohibited activities include but are not limited to illegal file sharing, cheating, hacking, and hosting of malicious content.
- Security: Customers are responsible for maintaining the security of their server(s), including applying necessary patches and updates to prevent unauthorized access.
- Support: Basic support is provided for issues related to the functioning of the hosting infrastructure. Additional support services may be available for purchase separately.
- Payment: Payment for hosting services must be made in accordance with the terms outlined in Section 4 (Payment and Billing).
- Termination: Customers may terminate their hosting services at any time. However, refunds for unused portions of the subscription period may not be provided, unless otherwise specified in the hosting plan.
- Limitation of Liability: Trinura is not liable for any damages or losses resulting from the use of hosting services, including but not limited to data loss, downtime, or security breaches.
15. Law and Jurisdiction
These terms and any disputes arising from or relating to them shall be governed by Swiss law. Any legal proceedings shall be brought exclusively in the courts of Switzerland, where Trinura, operated by Trinura Höpli, is based.
16. Indemnification
Customers agree to indemnify and hold Trinura, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Any violation of these terms and conditions.
- The use or misuse of Trinura's hosting services.
- Any content or activities hosted on the customer's server(s) that infringe upon the rights of any third party or violate any applicable laws or regulations.
- Any breach of security resulting from the customer's failure to maintain the confidentiality of their account credentials or any unauthorized access to their server(s).
17. Data Backup Policy
Upon the cancellation date of your hosting services with Trinura, all data backups associated with your account will typically be deleted. On some services, backups might remain available after server deletion for a limited period. However, Trinura does not guarantee the availability, retention, or integrity of these backups. It is the responsibility of the customer to ensure they have adequate backups of their data prior to cancellation. Trinura is not liable if backups are unavailable or inaccessible after the cancellation date.
18. User Conduct
Customers are expected to adhere to the following guidelines when using Trinura's hosting services:
- Do not engage in any illegal or malicious activities, including but not limited to cheating, hacking, phishing, spamming, or distributing malware.
- Do not infringe upon the intellectual property rights of others, including copyright, trademark, or patent infringement.
- Do not host or distribute any content that is unlawful, defamatory, obscene, harmful, or offensive.
- Do not attempt to gain unauthorized access to any servers, networks, or accounts, or interfere with the security or integrity of Trinura's hosting infrastructure.
- Do not use excessive server resources or engage in activities that may negatively impact the performance or stability of the hosting services for other users.
Trinura reserves the right to suspend or terminate the accounts of customers who violate these guidelines or engage in any prohibited activities.
19. Service Level Agreement (SLA)
Our Service Level Agreement (SLA) outlines the level of service you can expect from us, including uptime guarantees and support response times. By using our hosting services, you agree to abide by the terms and conditions laid out in the SLA.
20. Restricted Countries
Our hosting services are not available to individuals or entities located in or residents of certain countries due to legal and regulatory restrictions. If you are located in or are a resident of any of the following countries, you are not permitted to register for or use our services:
Sanctioned Countries
Iran, Iraq, Cuba, North Korea, Syrian Arab Republic, Sudan
Conflict Zones
Crimea, Donetsk, Kherson, Luhansk, Zaporizhzhia
Other Restricted Countries
Eritrea, Kyrgyzstan, Afghanistan, Lebanon, Libya, Palestinian Territory, Somalia, Yemen, Liberia
If you attempt to register from one of these countries, your registration will be denied, and access to our services will be restricted. We reserve the right to update this list as necessary to comply with legal requirements.
